WINDOW FILM WARRANTY STATEMENT

 

Lifetime Limited Warranty

Covr Group Limited and any of its affiliates and subsidiaries(“CovrGard”) warrants CovrGard automotive window films, when professionally installed by authorised dealers, to be free from product manufacturing defects such as adhesive failure, bubbling, cracking, peeling, delamination and fading. This limited warranty only extends to the original purchaser, is not transferable and does not include coverage for improper installation (including but not limited to installation which is not executed in accordance with the CovrGard installation guidelines) or poor installation quality.

Obligations

The obligation of Covr Group under this warranty is limited to replacement cost of the film only which is determined to be defective under these warranty terms. The authorised warranty servicing dealer must obtain prior approval from Covr Group Limited’s warranty service department prior to providing warranty service to the original purchaser.

This limited warranty is made in lieu of all warranties expressed or implied. Any implied warranties of fitness for a particular purpose or merchantability applicable to the product last only as long as the written warranties enumerated herein. In no event shall Covr Group be responsible for any loss or direct, incidental, or consequential damages or limitation on how long an implied warranty lasts so the above limitations and/or exclusion shall not apply to you. Furthermore, Covr Group shall not be liable in any manner whatsoever for damages related to use of this product in an illegal manner. This warranty gives you specific legal rights, which may vary from state to state. It is the responsibility of the original purchaser to first notify an authorised dealer, of the defect promptly upon its discovery, by defining the defect in detail and declaring which claims are asserted. Authorised dealers must be permitted sufficient time and opportunity to inspect and examine the products that were claimed to be defective to evaluate and respond to any warranty claim.

All decisions regarding the existence of manufacturing defects which are covered by this limited warranty shall be made by Covr Group and shall be final and binding.

Exclusions

This warranty is void if the CovrGard automotive window film is subject to improper care and cleaning, abuse, product misuse and applications on not recommended substrates or illegal installation. This product is to be used in compliance with all applicable country, state and provincial laws. Installation of the product in a manner that violates any of these laws is a misuse of the product and voids all warranties, expressed or implied, but not limited to the warranty of merchantability. Covr Group expressly disclaims all other warranties not set forth herein, including the implied warranty of fitness for a particular purpose and the implied warranty of merchantability.

Limitation Of Liability

NO CLAIM BY THE BUYER/OWNER OF ANY KIND, INCLUDING CLAIMS FOR INDEMNIFICATION, SHALL BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE PRODUCTS IN RESPECT TO WHICH DAMAGES ARE CLAIMED. IN NO EVENT SHALL THE COMPANY BE LIABLE TO BUYER/OWNER IN TORT, CONTRACT OR OTHERWISE, FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, RELIANCE, STATUTORY, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF USE, LOSS OF TIME, LOSS OF REVENUES, INCONVENIENCE, LOSS BUSINESS OPPORTUNITIES, DAMAGE TO GOOD WILL OR REPUTATION, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES COULD HAVE BEEN REASONABLY FORESEEN, IN CONNECTION WITH, ARISING OUT OF, OR AS A RESULT OF, THE SALE, DELIVERY, SERVICING, USE OR LOSS OF USE OF THE PRODUCTS SOLD HEREUNDER, OR FOR ANY LIABILITY OF BUYER TO ANY THIRD PARTY WITH RESPECT THERETO.
